Terms of Service

These terms govern your use of the Curo Pumps website and the pump selection, sizing and quotation tools available on it (together, the "Platform"). By using the Platform you agree to these terms. If you are using it on behalf of a company, you confirm you are authorised to accept these terms for that company.

1. Who we are

The Platform is operated by Curo Pumps (Pty) Ltd, registration number [company registration number], a private company incorporated in South Africa with its principal address at 6 Cranbourne Avenue, Benoni, 1500, Gauteng, South Africa. References to “we”, “us” and “our” mean Curo Pumps (Pty) Ltd.

Quotations issued through the Platform may be issued by Curo Pumps (Pty) Ltd, Curo Trading (Pty) Ltd or Curo Pumps Mauritius (Pty) Ltd. The issuing entity is identified on each quotation and is the party contracting with you in respect of that quotation.

2. Accounts and access

Parts of the Platform are open to the public. Others — including the quotation builder, saved quotations and administrative functions — require an account. Accounts are issued by us to staff and approved business partners; you cannot self-register.

  • You must keep your sign-in credentials confidential and must not share your account with anyone else.
  • You are responsible for everything done under your account.
  • You must tell us promptly if you believe your account has been accessed without your authority.
  • We may suspend or withdraw access at any time, including where an account is no longer required or these terms have been breached.

3. Engineering outputs are indicative

This is the most important term in this document, so please read it carefully.

The Platform produces pump selections, performance curves, impeller trim and variable speed calculations, efficiency estimates, NPSH figures, power draw, motor sizing and related engineering outputs. These are generated from manufacturer data and standard affinity-law modelling. They are provided as an engineering aid only.

  • Outputs are indicative and are not a substitute for professional engineering judgement.
  • Actual performance depends on installed conditions, fluid properties, system design, instrumentation accuracy and installation quality, none of which the Platform can verify.
  • Curve data, trim and speed calculations are derived from published envelopes and tolerances. Real equipment varies within those tolerances.
  • You remain responsible for verifying any selection against the duty, the fluid, the site conditions and the applicable standards before ordering, installing or commissioning equipment.

Where a selection is safety-critical, involves hazardous or non-standard fluids, or falls outside a pump's published operating envelope, you must obtain written confirmation from us before relying on it.

4. Quotations and pricing

  • A quotation generated on the Platform is an invitation to do business and is not a binding offer unless we confirm it in writing.
  • Quotations are valid for 30 days from their date of issue unless stated otherwise on the quotation itself. After that they expire automatically.
  • Prices are quoted in South African Rand unless the quotation states otherwise. Any foreign-currency figure shown is an approximate conversion for convenience, calculated at an indicative exchange rate at the time of generation, and is not a fixed price.
  • Prices exclude VAT unless expressly stated, and exclude delivery, installation, commissioning and any duties or levies unless itemised.
  • Lead times shown are estimates based on expected stock and manufacturing capacity. They are not guaranteed delivery dates.
  • We may correct manifest errors in pricing, specification or calculation at any time, including after a quotation has been issued.

Any resulting supply of goods or services is governed by our standard terms and conditions of sale, which prevail over these terms in the event of a conflict relating to that supply.

5. Acceptable use

When using the Platform you must not:

  • use it unlawfully, or in a way that infringes anyone else’s rights;
  • attempt to gain unauthorised access to any part of it, any account, or any server or network connected to it;
  • scrape, harvest, bulk-extract or systematically copy pricing, catalogue or curve data;
  • reverse engineer, decompile or attempt to derive the source of the Platform or its calculation methods;
  • introduce malicious code, or take any action that imposes an unreasonable load on our infrastructure;
  • misrepresent Platform output as independently verified engineering certification; or
  • resell, sublicense or commercially exploit access to the Platform without our written consent.

6. Intellectual property

The Platform, its design, software, databases, pump curve data, catalogue content, documentation and branding are owned by us or our licensors and are protected by copyright and other intellectual property laws. Nothing in these terms transfers any of those rights to you.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for the purpose of evaluating, specifying and procuring pumping equipment from us. You may download, print and share quotations, datasheets and curves generated for your own projects. All other use requires our written consent.

Third-party manufacturer names, model designations and trade marks referenced on the Platform remain the property of their respective owners and are used for identification only.

7. Content you enter

You keep ownership of the project, customer and specification information you enter. You grant us a licence to store and process it so we can operate the Platform, produce your quotations and provide support. Where that information identifies individuals, our Privacy Policy explains how we handle it.

You confirm you are entitled to provide any third-party information you enter, including end-customer contact details, and that doing so does not breach any obligation you owe to that third party.

8. Availability

We aim to keep the Platform available but do not guarantee uninterrupted access. We may suspend, withdraw or change any part of it — including removing pumps, ranges or features — without notice. Saved quotations may be archived or removed in line with our retention practices.

9. Limitation of liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection Act 68 of 2008 where it applies.

Subject to that, and to the maximum extent permitted by law:

  • the Platform is provided "as is" and we give no warranty that its outputs are accurate, complete or fit for any particular purpose;
  • we are not liable for loss of profit, loss of production, loss of contracts, loss of data, equipment damage, or any indirect or consequential loss arising from use of the Platform or reliance on its outputs; and
  • our total liability arising out of or in connection with the Platform is limited to the value of the specific order to which the claim relates, or ZAR 10,000, whichever is greater.

This clause does not limit any rights you have under a separate written supply contract with us in respect of equipment actually supplied.

10. Indemnity

You indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your unlawful use of the Platform, or your reliance on Platform output without the verification described in clause 3.

11. Changes to these terms

We may update these terms from time to time. The version published on this page is the one that applies, and the date at the top shows when it last changed. Material changes affecting account holders will be notified by email or in the Platform. Continuing to use the Platform after a change means you accept the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. The parties submit to the non-exclusive jurisdiction of the South African courts. Before starting proceedings, please contact us so we can try to resolve the matter directly.
